DCG Wins Appeal on Lien/Contract Rights

February 22, 2019 – On February 22, 2019, the El Paso Court of Appeals affirmed a DGC client win in a dispute over whether a settlement released and extinguished statutory mineral property liens.  Prior to attempting to foreclose upon liens placed on mineral property, the lienholders settled and released the debts underlying the liens.  The trial court and the El Paso court both refused to allow foreclosure on the basis that the liens were automatically extinguished once the debt was extinguished.  The matter involved four separate proceedings that were consolidated for trial and appeal.  DGC shareholders Jad Davis and Julie Griffis represented the mineral property owner.
